ASU negotiates unique terms to protect its Ice Hockey Team's media options
I just received Arizona State’s agreement with the Big 12 Conference. The full agreement is attached below. I see three provisions of note.
1. ASU accepts 99 year Big 12 membership
First, they accepted the 99 year term for their membership agreement. Colorado accepted this as well. Utah negotiated an exception. My reading of the Utah’s exemption is that they agree to be bound to any future change to the 99 year term. If there is no change to this provision, Utah may be subject to less penalties if it withdraws from the conference. Consult a lawyer if you want more details on the meaning of this exemption. Below I provide ASU’s agreement to be bound by conference bylaws, Utah’s exemption, the section of the bylaws referenced in Utah’s exemption, the section of Utah’s agreement that defines the Commencement Date of its agreement with the Big 12, and the section of the Big 12 bylaws that refers to the withdrawing from the conference.

Second item of note, sloppy drafting also found in Colorado’s agreement with the Big 12. ASU does not specify when its revenue sharing begins. Utah’s agreement set a date certain.

3. ASU Limits Grant of Rights with Big 12
Third, ASU negotiated a limited Grant of Rights for media broadcasts, carving out sports that are not sponsored by the Big 12. These include ice hockey, beach volleyball, women’s lacrosse, triathlon, and women’s water polo.
